The Dept. of Legal Affairs was created in 1969 (Ch. 69-106, Laws) to perform the powers, duties and functions of the office of the Attorney General. The Attorney General heads the department and is the chief State legal officer (Chapter 16, Florida Statutes). The Attorney General renders legal opinions on request to government agencies. The Department provides all legal services required by any department, unless otherwise provided by law. The Citizens Commission on Cabinet Reform was established at the January 24, 1995 Cabinet Meeting to review the statutory functions and responsibilities of the Governor and Cabinet sitting as a collegial body. Governor Reubin O'D. Askew chaired the commission, Governor Bob Martinez served as vice-chair, Ms. Pat Gleason of the Office of Attorney General served as General Counsel, and Dr. Lance deHaven-Smith served as Staff Director. Other members were the Honorable Jim Smith, Honorable Marilyn Evans-Jones, Mr. Rod Petrey, Mr. Leroy Collins, Jr., Mr. James Eaton, Dr. Pearl Spears Gray, and Dr. Stanley Marshall.
The commission's final report included 46 recommendations for shifting, altering, or retaining as is the current placement of functions for which the Governor and Cabinet had some responsibility or authority. The report was adopted at the commission's final meeting on December 11, 1995 and was presented to the Governor and Cabinet at the December 12, 1995 Cabinet Meeting.
This series consists of records of the Citizens Commission on Cabinet Reform maintained by Pat Gleason, General Counsel in the Office of the Attorney General, who served as General Counsel to the commission. The records include historical and background information about the Florida Cabinet; news clippings regarding cabinet reform; tape recordings and minutes of monthly commission meetings; meeting notices and agenda; and background materials for each meeting. The records reflect the numerous topics addressed and proposals considered by the commission, among them the abolishment of the Department of Commerce and transfer of its functions to Enterprise Florida and the Florida International Affairs Commission; transfer of the Division of Motor Vehicles and Division of Driver Licenses from the Department of Highway Safety and Motor Vehicles to the Department of State, and transfer of the Florida Highway Patrol from Highway Safety and Motor Vehicles to its own department under the Governor; repeal of laws providing for budget appeal to the Governor and Cabinet; and the roles of the Governor and Cabinet in environmental, public lands, and growth management matters.
